To ensure a smooth and enjoyable experience, please review our terms and conditions outlined below. These are designed to protect both you and us and to clarify our mutual expectations.

Definitions

• • Client: Refers to the person or organization requesting our photographic services and the supply of photographs.
  • Photographer: Refers to Seagull Photography and all its representatives, including photographers, directors, and assistants.

1. Acceptance of Terms: By making a payment (deposit or final balance) to Seagull Photography, you acknowledge that you have read and understood these terms and conditions. Your payment signifies your acceptance of this agreement as a legally binding contract, unless otherwise agreed to in writing before accepting our services.

2. Photography Rates & Packages: Our rates and packages are subject to change. Cost estimates provided are valid for 30 days or as specified. Please confirm rates directly with us to ensure they are current.

3. Booking Reservation: A non-refundable deposit of 50% is required to secure your booking date and chosen package. Bookings are confirmed only upon receipt of proof of payment. Reservations are on a first-come, first-served basis. If we receive an inquiry for your date before you confirm and pay, we may book that date to another client.

4. Payment Balance after Deposit: The remaining balance must be paid in full 1 month (30 days) before your wedding date, or 10 days before any other package that is not a wedding shoot. The deposit secures your date and pricing. Full payment is required before we begin any work.

5. Additional Fees & Requirements

   • Travel Fees: Additional charges apply for travel beyond 30km from Gordon’s Bay, Western Cape. Travel rates will be quoted per Kilometer traveled from Gordon’s Bay and back to Gordon’s Bay using standard AA rates. For evening events further than 100km, we require a suitable B&B/hotel for one – three people (depending on your package), arranged and paid for by you. Confirmation and details of this are to be sent to us 7 days before the booked date.
   • Catering: Please provide meals and drinks for our photographers and makeup artists/stylists, as well as seating at the main reception venue to ensure we do not miss important events. It is preferred that we have our own table so our equipment does not obstruct your guests.
   • Additional Expenses: Costs incurred due to changes in the brief or unforeseen circumstances will be billed to the client. Venue-related fees are the client’s responsibility.

6. Cancellation or Rescheduling: Deposits are non-refundable if you cancel your package. If you need to reschedule, please notify us as soon as possible. We will attempt to accommodate the new date, but rates and availability may vary.

7. Session Duration and Punctuality: Our photography session duration is based on your chosen package. Any additional time will incur extra charges (R1,000 per hour or part thereof). We recommend adhering to a clear timeline to ensure a smooth session.

8. Copyright and Usage: Seagull Photography retains copyright of all images. You are granted an exclusive license for personal use only, contingent on full payment. Redistribution, commercial use, or modification of images is not permitted without explicit written consent.

9. Editorial Use and Styled Shoots: When images are used editorially, a credit line in the form of “Seagull Photography” must be provided. All service providers must credit us for our images.

10. Model Release and Use of Images: We retain the right to use photographs for promotional purposes. By engaging our services, you consent to the use of your images in our marketing materials.

11. Liability: In the rare event that we are unable to fulfill our contract due to illness or other emergencies, we will provide a replacement photographer or return your payment. We are not liable for any damages or losses beyond returning your payment. We take great care in handling your images but are not liable for losses or damages beyond the return of payments or arranging a makeup session.

    Please note that Seagull Photography does not have liability insurance. All photoshoots are conducted at your own risk. We are not responsible for any injury, theft, or personal loss occurring during our services.

12. Images and Products: Image quantity is based on your selected package. All images are subject to our discretion. Additional edits or requests after delivery will incur a fee. We provide teaser images shortly after the session, with final high and low-resolution images delivered within 2-4 weeks. Images are archived for at 30 days on our server; it is your responsibility to make sure you download your photos to your devices within these 30 days. You will receive an email along with a reminder email closer to the 30 days deadline.

13. RAW/UNPROCESSED IMAGES: Please note that Seagull Photography does not provide RAW or unprocessed images to clients under any circumstances. All images delivered to clients are fully edited and processed to ensure the highest quality. We appreciate your understanding in this matter. Our service involves not just capturing photos but also processing and enhancing them to deliver a complete package that you will love. Unprocessed photos will not reflect the quality of work we aim to offer our clients.

14. Cancellations Without Just Cause: In the rare event of a cancellation without just cause, the funds paid are non-refundable, as another client could have been booked on this date. We retain the right, at our discretion, to decide on any refund amount. However, we understand that circumstances can change, and we are happy to work with you to reschedule your booking date, subject to availability. Please inform us as soon as possible if you need to reschedule so we can make the necessary arrangements.

15. General Terms: This agreement is governed by the laws of the Republic of South Africa. Any disputes will be handled according to these laws.
